Terms and Conditions

These Terms and Conditions govern your access to and use of Focused3D.com and your purchase of products or services from Focused3D LLC.

By accessing this website, submitting a quote request, placing an order, or purchasing a product or service, you agree to these Terms and Conditions. If you do not agree with these terms, do not use the website or complete a purchase.

1. About Focused3D

Focused3D.com is owned and operated by Focused3D LLC, a Michigan limited liability company.

Focused3D designs, manufactures, and sells products that may include:

  • TentGrip canopy accessories

  • Focused3D mounting products

  • 3D-printed products

  • Custom-designed parts

  • Prototypes

  • Replacement components

  • CAD and product-development services

  • Small-batch manufacturing services

2. Eligibility to Use the Website

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to place an order or submit a project request.

By placing an order, you represent that:

  • The information you provide is accurate and complete.

  • You are authorized to use the selected payment method.

  • You are legally permitted to enter into the transaction.

  • Your purchase will be used only for lawful purposes.

3. Product Information

Focused3D makes reasonable efforts to provide accurate product descriptions, measurements, photographs, compatibility information, prices, and availability.

However:

  • Product colors may appear differently depending on lighting, photography, screen settings, and material batches.

  • Measurements may be approximate unless a specific tolerance is stated.

  • 3D-printed products may display normal layer lines, seams, support marks, texture variations, or other characteristics of the manufacturing process.

  • Minor cosmetic differences that do not affect ordinary function are not necessarily defects.

  • Product designs, materials, packaging, included hardware, or specifications may be updated when necessary to improve performance or availability.

Customers are responsible for reviewing the complete product description and selecting the correct size, color, orientation, quantity, and other available options before ordering.

Contact Focused3D before ordering when compatibility or measurements are uncertain.

4. TentGrip Fit and Compatibility

TentGrip products are designed to fit canopy legs of multiple shapes within the size range stated on the applicable product page.

Compatible shapes may include:

  • Round

  • Square

  • Hexagonal

  • Octagonal

  • Other similarly shaped canopy legs

Customers must measure across the widest outside point of the canopy leg.

Compatibility depends on the actual dimensions and shape of the frame, not solely on the canopy brand or advertised model.

Unless Focused3D confirms compatibility in writing based on accurate customer-provided information, the customer remains responsible for selecting a product that falls within the stated fit range.

Canopy designs may change between models or production years. Compatibility with one canopy from a particular brand does not guarantee compatibility with every canopy made by that brand.

5. Product Options and Quantities

Some products are available in different:

  • Colors

  • Pack sizes

  • Orientations

  • Pole openings

  • Mount sizes

  • Device sizes

  • Support sizes

A pack-size option identifies the number of products included in one selected set. The separate quantity box at checkout identifies how many complete sets are being purchased.

Customers should review the cart before payment to confirm that all options and quantities are correct.

6. Orders and Order Acceptance

Submitting an order does not guarantee that the order has been accepted.

Focused3D may accept, reject, limit, or cancel an order for reasons including:

  • Product unavailability

  • Pricing or listing errors

  • Suspected fraud or unauthorized payment

  • Incomplete or inaccurate customer information

  • Shipping restrictions

  • Safety concerns

  • Material or production limitations

  • An inability to complete the order as requested

An automated order confirmation means that the order was received. It does not necessarily mean that the order has entered production or been finally accepted.

If Focused3D cancels a paid order, the amount paid for the canceled portion will be refunded to the original payment method.

7. Prices, Payments, and Taxes

Prices are displayed in U.S. dollars unless otherwise stated.

Focused3D may change prices at any time. Price changes do not affect an order that has already been accepted unless the customer approves a change.

Customers are responsible for:

  • Product charges

  • Applicable sales taxes

  • Shipping charges not covered by an active free-shipping offer

  • Expedited shipping charges

  • Customs duties, import taxes, or brokerage charges where applicable

  • Approved custom-design or modification charges

Payment must be successfully authorized before an order is fulfilled unless separate written payment terms have been approved.

Promotional codes:

  • Must be entered before completing checkout.

  • Cannot be applied retroactively unless Focused3D chooses to do so.

  • May be limited by product, date, quantity, customer, or order value.

  • May not be combined unless specifically permitted.

  • Have no cash value.

8. Shipping and Delivery

Shipping and delivery are governed by the separate Shipping Policy published on Focused3D.com. The Shipping Policy is incorporated into these Terms and Conditions.

Most standard products are made or prepared to order. The estimated processing time shown on the website or provided with the order is an estimate rather than a guaranteed delivery date.

Focused3D will make reasonable efforts to ship orders within the stated timeframe.

If an order cannot ship within the timeframe originally promised, Focused3D may contact the customer with a revised shipment estimate and provide available cancellation or refund options as required by applicable law.

Carrier delivery dates are estimates and may be affected by weather, holidays, address problems, carrier disruptions, or other events beyond Focused3D’s reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

9. Returns, Exchanges, and Refunds

Returns, exchanges, refunds, damaged shipments, incorrect products, and cancellations are governed by the separate Returns and Exchanges Policy published on Focused3D.com. That policy is incorporated into these Terms and Conditions.

Customers must obtain approval and return instructions before sending a product back.

Standard products may be eligible for return when they satisfy the requirements and deadline stated in the Returns and Exchanges Policy.

Custom, personalized, modified, or specially fabricated products may not be returnable once production has started, except when Focused3D made an error or the product has a confirmed manufacturing defect.

Nothing in these terms eliminates rights or remedies that cannot legally be waived.

10. Custom Projects and Quote Requests

Submitting a quote form does not create a contract or require either party to proceed with the project.

A custom project begins only after the applicable requirements have been completed, which may include:

  • Written approval of the project scope

  • Approval of measurements or drawings

  • Approval of estimated pricing

  • Payment of a deposit or invoice

  • Confirmation of materials, quantities, and timing

Quotes are based on the information available when they are prepared.

Focused3D may revise a quote when:

  • Measurements change.

  • The project scope changes.

  • Additional design work is required.

  • Material or hardware costs change.

  • Previously undisclosed requirements are identified.

  • The customer requests additional quantities or features.

A quote remains valid only for the period stated on the quote. When no validity period is stated, the quote may be revised before acceptance.

11. Customer Measurements and Approvals

Customers are responsible for providing accurate:

  • Measurements

  • Dimensions

  • Photographs

  • Models

  • Drawings

  • Material requirements

  • Fit requirements

  • Intended-use information

A custom product manufactured correctly from inaccurate customer-provided information is not considered defective.

When Focused3D provides a drawing, rendering, model, prototype, or design for approval, the customer is responsible for reviewing:

  • Dimensions

  • Orientation

  • Hole locations

  • Text

  • Spelling

  • Fit

  • Quantity

  • Material

  • Color

  • Intended function

Approval authorizes Focused3D to proceed based on the approved information.

Changes requested after approval may require additional charges and may affect the completion date.

12. Prototypes and Experimental Products

A prototype is an evaluation product and may not have the appearance, durability, tolerances, finish, or performance of a final production product.

Prototype testing may reveal the need for:

  • Design revisions

  • Material changes

  • Dimensional changes

  • Additional prototypes

  • Different hardware

  • Different manufacturing processes

Unless otherwise agreed in writing, the cost of additional prototypes or revisions is not included in the cost of an earlier prototype.

The customer is responsible for testing and approving a prototype before ordering production quantities.

13. Customer-Provided Files and Intellectual Property

Customers may provide photographs, drawings, logos, trademarks, CAD files, digital models, or other materials for use in a project.

By submitting those materials, the customer represents that:

  • The customer owns the materials or has permission to use them.

  • Focused3D is authorized to use them for the requested project.

  • The requested work does not knowingly infringe another party’s patent, copyright, trademark, trade secret, or other rights.

The customer grants Focused3D a limited license to use the submitted materials as necessary to evaluate, quote, design, manufacture, and support the requested project.

Focused3D may refuse work that appears unlawful, unsafe, deceptive, infringing, or outside its capabilities.

The customer is responsible for claims resulting from materials or instructions supplied by the customer, except to the extent caused by Focused3D’s own unauthorized use or misconduct.

14. Ownership of Designs and Production Files

Purchasing a physical product does not automatically transfer ownership of:

  • CAD files

  • Source files

  • Editable models

  • Manufacturing drawings

  • Tooling designs

  • Fixtures

  • Print profiles

  • Production methods

  • Internal design files

Unless a written quote or agreement states otherwise:

  • Customer-provided original files remain the customer’s property.

  • Focused3D retains ownership of original designs, adaptations, manufacturing files, fixtures, methods, and improvements created by Focused3D.

  • The customer receives ownership of the completed physical products that have been purchased and paid for.

  • Digital design files are not included unless they are specifically listed as a deliverable.

Any transfer or license of digital design rights must be agreed to in writing.

15. Confidential Project Information

Focused3D will use reasonable care when handling nonpublic customer project information.

Customers should clearly identify confidential materials before submitting them.

Unless a separate written nondisclosure agreement has been signed, submitting information through the website, email, or quote form does not create a formal confidentiality agreement beyond the obligations imposed by applicable law and the Privacy Policy.

Do not submit export-controlled, classified, highly sensitive, or legally restricted information through standard forms or email.

16. Product Installation and Use

Customers are responsible for properly installing, inspecting, maintaining, and using products according to:

  • The product description

  • Included instructions

  • Warning information

  • Applicable equipment-manufacturer instructions

  • Reasonable safety practices

Before each use, inspect the product and supporting equipment for:

  • Cracks

  • Deformation

  • Loose hardware

  • Excessive wear

  • Heat damage

  • Impact damage

  • Improper fit

  • Movement or slipping

Stop using a product if it is damaged, worn, loose, improperly fitted, or being used outside its intended purpose.

Do not overtighten mounts or hardware.

17. TentGrip Safety Limitations

TentGrip accessories are intended to organize, hold, or display ordinary booth and event items as described on the applicable product page.

Unless specifically stated otherwise, TentGrip products are not designed to:

  • Anchor or secure a canopy

  • Replace manufacturer-required canopy weights

  • Hold sandbags

  • Support a person

  • Lift or suspend a person

  • Serve as fall protection

  • Serve as structural bracing

  • Serve as emergency or life-safety equipment

  • Secure hazardous materials

  • Be used as part of a vehicle-restraint system

TentGrip accessories should be removed during severe weather, high winds, canopy movement, transportation, or whenever the canopy manufacturer recommends removing attached accessories.

Customers remain responsible for properly weighting, anchoring, operating, and supervising their canopy according to the canopy manufacturer’s instructions and event requirements.

18. Environmental and Material Limitations

3D-printed materials can be affected by:

  • Heat

  • Direct sunlight

  • Ultraviolet exposure

  • Chemicals

  • Repeated impacts

  • Excessive tightening

  • Heavy loads

  • Long-term outdoor exposure

  • Freezing conditions

Products should not be placed near open flames, hot equipment, or surfaces that exceed the material’s intended operating conditions.

Color alone does not guarantee protection from high temperatures.

Unless a product is specifically described as permanently weatherproof, long-term outdoor storage is not recommended.

19. No Professional Engineering Certification

Unless expressly stated in a written agreement, Focused3D products, CAD services, prototypes, recommendations, and custom parts are not provided as:

  • Licensed professional engineering services

  • Building-code certification

  • Safety certification

  • Medical-device certification

  • Automotive certification

  • Aerospace certification

  • Load-bearing structural certification

  • Regulatory approval

Customers are responsible for obtaining any engineering review, testing, inspection, certification, or regulatory approval required for their intended application.

20. Limited Product Remedy

If a product arrives damaged, incorrect, incomplete, or with a confirmed manufacturing defect, contact Focused3D within the reporting period stated in the Returns and Exchanges Policy.

Depending on the circumstances, Focused3D may provide an appropriate remedy such as:

  • Replacement

  • Repair

  • Remanufacture

  • Missing components

  • Exchange

  • Partial refund

  • Full refund

The appropriate remedy will depend on the nature of the problem, product condition, available evidence, and applicable law.

This section does not create an extended warranty or guarantee a particular service life.

Except for promises expressly stated in writing and rights that cannot be excluded under applicable law, products and services are provided without additional guarantees regarding uninterrupted use, suitability for an unstated purpose, or performance outside the published specifications.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Focused3D LLC will not be responsible for indirect, incidental, special, exemplary, or consequential damages resulting from:

  • Improper installation

  • Misuse

  • Modification

  • Overloading

  • Use outside published specifications

  • Inaccurate customer measurements

  • Customer-approved design errors

  • Failure to follow instructions

  • Damage to a canopy, vehicle, device, sign, or other attached property

  • Lost profits, lost sales, or business interruption

  • Severe weather or environmental exposure

  • Carrier delays or events outside Focused3D’s reasonable control

To the fullest extent permitted by applicable law, Focused3D’s total liability arising from a product or service will not exceed the amount actually paid to Focused3D for the product or service giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

22. Website Content and Intellectual Property

Unless otherwise indicated, the website and its content are owned by or licensed to Focused3D LLC.

Protected content may include:

  • Product designs

  • Photographs

  • Videos

  • Logos

  • Product names

  • Written descriptions

  • Graphics

  • Instructions

  • CAD renderings

  • Website layout

  • Marketing materials

Website content may not be copied, reproduced, republished, sold, distributed, or used commercially without written permission.

Customers may share links to public product pages and Focused3D social-media content for ordinary noncommercial purposes.

23. Customer Reviews and Submitted Content

Customers may submit reviews, photographs, comments, testimonials, or other content when those features are available.

Submitted content must not:

  • Be knowingly false or deceptive

  • Contain unlawful threats or harassment

  • Infringe another party’s rights

  • Reveal another person’s private information

  • Contain malicious software or spam

  • Promote illegal activity

Focused3D may remove content that violates these requirements or applicable law.

Focused3D will not prohibit or penalize customers for posting an honest review or expressing a genuine opinion about their experience.

By voluntarily submitting content for public display, the customer grants Focused3D a nonexclusive, royalty-free license to display, reproduce, and share that content in connection with the website, products, and marketing, subject to applicable law and any separate agreement.

24. Prohibited Website Uses

You may not use the website to:

  • Commit fraud

  • Submit false payment information

  • Attempt unauthorized access

  • Introduce malicious software

  • Scrape or copy protected content in an abusive manner

  • Interfere with website operation

  • Impersonate another person

  • Violate intellectual-property rights

  • Submit unlawful or harmful project requests

  • Circumvent product limits, security features, or checkout controls

Focused3D may restrict access, cancel orders, or report suspected unlawful activity when appropriate.

25. Third-Party Services and Links

The website may use or link to services provided by Wix, payment processors, shipping carriers, social-media platforms, analytics services, advertising platforms, and other third parties.

Focused3D does not control every third-party service and is not responsible for its availability, content, security, or independent policies.

Use of a third-party service may be subject to that provider’s terms and privacy policy.

26. Privacy

Collection and use of personal information are governed by the Focused3D Privacy Policy, which is incorporated into these Terms and Conditions.

By using the website, you acknowledge that website operations may involve processing information through Wix and other service providers necessary for hosting, payment, shipping, analytics, customer service, and related business functions.

27. Events Beyond Reasonable Control

Focused3D is not responsible for delay or failure caused by circumstances beyond its reasonable control, including:

  • Severe weather

  • Natural disasters

  • Fire

  • Power or internet outages

  • Equipment breakdown

  • Material shortages

  • Carrier disruptions

  • Labor interruptions

  • Government actions

  • Public emergencies

  • Supplier failures

  • Transportation disruptions

Focused3D will make reasonable efforts to communicate significant delays and provide available options.

28. Governing Law

These Terms and Conditions are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.

Any dispute that is not resolved informally will be handled by a court with proper jurisdiction in the State of Michigan.

Nothing in this section prevents a consumer from exercising rights that cannot legally be waived under the laws applicable to that consumer.

29. Severability

If any provision of these Terms and Conditions is found invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

30. No Waiver

A failure by Focused3D to enforce a provision on one occasion does not waive the right to enforce that provision later.

31. Entire Agreement

These Terms and Conditions, together with the applicable:

  • Product description

  • Accepted quote

  • Invoice

  • Shipping Policy

  • Returns and Exchanges Policy

  • Privacy Policy

  • Written project agreement

constitute the agreement between Focused3D and the customer concerning the applicable transaction.

When a signed custom-project agreement directly conflicts with these general terms, the signed project agreement controls for that project.

32. Changes to These Terms

Focused3D may update these Terms and Conditions when business practices, website features, products, or legal requirements change.

The revised version will be posted on this page with a new “Last updated” date.

Changes apply prospectively and do not retroactively change an accepted order unless required by law or agreed to by the customer.
